These Terms of Use (“Terms”) govern your access to and use of the website www.xitplan.ca and any content, features, or resources available on it (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Who we are

The Site is operated by XitPlan Inc. (“XitPlan”, “we”, “us”, “our”), a company registered in Canada.

2. Scope of these Terms

These Terms apply to your use of:

  • The public pages and content on xitplan.ca
  • Blog posts, articles, and guides
  • Quizzes, lead magnets, and downloadable resources provided through the Site
  • Newsletter sign up forms and email content that originates from the Site

Separate terms and privacy policies may apply to specific products, apps, or tools created by XitPlan, such as FreedomOS or any other XitPlan product. In case of conflict between these Terms and product specific terms, the product specific terms will govern your use of that product.

3. Eligibility

You may use the Site only if:

  • You are at least 18 years old, or
  • You are the age of majority in your place of residence and are able to form a binding agreement

By using the Site, you confirm that you meet these requirements.

4. Educational content, not personal advice

The Site provides educational content and general information related to money, systems, productivity, habits, tools, experiments, and similar topics.

You understand and agree that:

  • Content on the Site is for education and general information only
  • Nothing on the Site is personal financial, investment, tax, legal, or accounting advice
  • Nothing on the Site is a recommendation to buy or sell any asset or to take any specific financial action
  • XitPlan is not acting as your financial advisor, portfolio manager, tax professional, accountant, or lawyer
  • You are solely responsible for your own financial, business, and life decisions

You should always consult a qualified professional before making financial, tax, legal, or business decisions.

5. Accounts, newsletter, and communications

Some parts of the Site may allow you to:

  • Join a newsletter or email list
  • Download resources
  • Submit forms or questions
  • Request updates or contact us

When you provide information, you agree to:

  • Submit accurate and up to date information
  • Not impersonate another person

You can unsubscribe from newsletters or marketing emails at any time using the link in the email or by contacting us. We may still send service or legal notices where necessary.

6. Acceptable use

You agree that you will not:

  • Use the Site for any unlawful, fraudulent, or harmful purpose
  • Attempt to gain unauthorized access to any systems, accounts, data, or networks
  • Interfere with or disrupt the security or operation of the Site
  • Copy, scrape, or harvest Site content in bulk for commercial use without our written permission

We may restrict or terminate your access to the Site if we reasonably believe you have violated these Terms or used the Site in a way that may harm us or others.

Unless stated otherwise, XitPlan owns all rights in and to the Site and its content, including:

  • Layout and overall look and feel of the Site

  • Share links to public pages of the Site

All trademarks, trade names, logos, and product names on the Site are the property of their respective owners and may not be used without their permission.

8. User content and feedback

You may choose to send us feedback, messages, ideas, suggestions, survey responses, or other content (“Feedback”) through the Site or by email.

By providing Feedback, you agree that:

  • You grant XitPlan a worldwide, non exclusive, royalty free license to use, modify, reproduce, and act on that Feedback for any lawful business purpose
  • We are not required to use your Feedback
  • We are not required to compensate you for your Feedback
  • You will not send Feedback that is confidential or that infringes the rights of others

If your Feedback includes personal information, our use of that information is governed by our Privacy Policy.

9. Third party links and services

The Site may contain links to third party websites, resources, tools, or services, including:

  • Social media platforms
  • Payment processors
  • Email or course platforms
  • Affiliate product pages

We do not control and are not responsible for:

  • The content or practices of third party sites or services
  • Their availability, accuracy, or security
  • Their privacy or data handling practices

Your use of third party sites and services is at your own risk and subject to their own terms and policies.

10. No guarantee of results

We share systems, frameworks, experiments, and educational content about money, freedom, and personal operations. Your results will depend on your own actions, decisions, skills, and circumstances.

You understand and agree that we do not guarantee:

  • Any specific financial outcome
  • Any particular level of income, savings, profit, or investment returns
  • That you will achieve financial independence, freedom, or any defined result
  • That past examples, case studies, or testimonials reflect typical outcomes

Any examples or success stories on the Site are for illustration only and do not guarantee that you will achieve similar results.

11. Disclaimers

The Site and its content are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties and representations, whether express or implied, including but not limited to:

  • Warranties of accuracy, completeness, or reliability
  • Warranties of fitness for a particular purpose
  • Warranties that the Site will be secure, timely, uninterrupted, or error free

You use the Site at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, XitPlan Inc, its directors, officers, employees, contractors, and affiliates will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, business, opportunities, or data

arising out of or in connection with:

  • Your access to or use of the Site
  • Your reliance on any content on the Site
  • Any delay, interruption, error, or unavailability of the Site
  • Any third party content, services, or links accessed through the Site

In any case where we are found liable, our total liability will be limited to the amount you paid to XitPlan for access to the Site in the twelve months before the event that gave rise to the claim, or if you did not pay anything, one hundred Canadian dollars (CAD 100).

Some jurisdictions do not allow certain limitations of liability. In those cases, the limitations above apply only to the extent permitted by the laws of your jurisdiction.

13. Indemnity

You agree to indemnify and hold harmless XitPlan Inc and its directors, officers, employees, and contractors from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or related to:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any rights of a third party
14. Governing law and disputes

These Terms and any dispute or claim arising out of or relating to them or the Site are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict of law rules.

You agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute or claim arising from or relating to these Terms or your use of the Site, subject to any mandatory legal protections that apply in your place of residence.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page.

If we make material changes, we may also provide additional notice, such as a notice on the Site or by email where appropriate.

Your continued use of the Site after updated Terms are posted means you accept the changes.
